Notification

The product “Moulded Rubber Outsoles” is covered under the Footwear Made from All Rubber and All Polymeric Material and Its Components (Quality Control) Order, 2024, notified by the Department for Promotion of Industry and Internal Trade (DPIIT), Ministry of Commerce and Industry. The Order was issued via S.O. 1422(E) dated 15 March 2024, and amended through S.O. 3701(E) dated 30 August 2024 to allow sale of declared, uncertified stock manufactured or imported prior to the enforcement date.

Overview

The Quality Control Order (QCO) brings various footwear components under mandatory quality certification. Moulded rubber outsoles are critical components of footwear that provide durability, strength, and slip resistance. As per the QCO 2024, these products must meet the national standards to ensure performance, consistency, and safety in their application across footwear segments.

Objective & Scope

The objective of including Moulded Rubber Outsoles under this regulation is to ensure that these components meet minimum safety, design, and performance requirements. The relevant standard IS 5676:1995 prescribes the specification for hard rubber soles and heels, including requirements for hardness, flexibility, wear resistance, and dimensional stability. This enhances the durability and quality of footwear, especially in high-demand and industrial environments.

Product Covered

This regulation applies to Moulded Rubber Outsoles conforming to IS 5676:1995. These outsoles are used in various types of footwear including industrial safety shoes, casual shoes, and heavy-duty footwear, where ruggedness, abrasion resistance, and structural integrity are essential.

Industries Impacted

The QCO directly affects manufacturers of rubber footwear components, footwear assembly units, OEMs producing soles for third-party brands, institutional footwear suppliers, and vendors involved in public procurement of safety footwear.

Mandatory Compliance Requirements

From 1 August 2024, all Moulded Rubber Outsoles must be certified by the Bureau of Indian Standards (BIS) under Scheme-I of the BIS (Conformity Assessment) Regulations, 2018. These products must be tested in BIS-recognized laboratories and bear the ISI mark before being sold or distributed. Additionally, manufacturers must comply with labeling, packaging, traceability, and documentation norms laid out by BIS.

Next Steps for Stakeholders

Stakeholders must identify the applicability of IS 5676:1995 to their product range, apply for a BIS license, conduct product testing in BIS-approved labs, and begin using the ISI mark upon approval. Manufacturers or importers must declare any uncertified stock made or imported before 1 August 2024, and ensure such stock is fully sold or disposed of by 31 July 2026.

Exemptions Provided

This QCO does not apply to moulded rubber outsoles exclusively manufactured for export, or to Micro and Small Enterprises (MSEs) as defined under the MSMED Act, 2006. Additionally, imported outsole components used exclusively in the manufacture of export-bound footwear are exempted, provided a valid declaration is made.

Legal Provisions, Enforcement & Penalties

The Order is enforced under Sections 16, 17, and 25(3) of the BIS Act, 2016. The Bureau of Indian Standards (BIS) is the nodal authority for certification and enforcement. Non-compliance may result in product seizure, license suspension or cancellation, and penalties including fines or imprisonment up to 2 years under Section 29 of the BIS Act.

Supersession & Amendment Clause

The Footwear QCO 2024 fully supersedes the 2022 QCO and nullifies all prior amendments and the rescinded QCO 2020. The amendment order dated 30 August 2024 (S.O. 3701(E)) allows manufacturers and traders to continue selling pre-compliant stock until 31 July 2026, provided such stock is properly declared.

Conclusion

Effective 1 August 2024, all Moulded Rubber Outsoles covered under IS 5676:1995 must be BIS-certified and ISI-marked before being sold in India. Stakeholders should act swiftly to align their operations, certify their products, and manage legacy inventory within the defined compliance window. This move strengthens product safety and standardization in the Indian footwear industry.
